On the progress of customers' fulfillment of the minimum mandatory share of purchases of Russian goods

Association "StekloSouz" of Russia on the basis of clause 7 of the instructions of the Deputy Prime Minister of the Russian Federation Yu.I. Borisov (minutes of the meeting dated 04.19.2021 No. YuB-P7 is attached) organizes monitoring of the fulfillment by customers of the minimum share of purchases of Russian goods established by the decrees of the Government of the Russian Federation No. 2013 and 2014 dated 03.12.2020.

In accordance with Article 14 of Federal Law No. 44-AP and Article 3 of Federal Law No. 223-FZ, in order to support domestic producers, the Government of the Russian Federation has established minimum shares (quotas) for purchases of goods of Russian origin when purchasing goods, works, services to ensure state and municipal needs, as well as when making purchases by certain types of legal entities. The size of the quota is differentiated depending on the availability of Russian manufacturers and is intended to provide support to these manufacturers, including within the framework of the diversification of the military-industrial complex.

Based on the foregoing, I ask you to provide information on the facts of violation of the current legislation in relation to products for which mandatory purchase quotas are established, on the following issues:

- cases of application by state customers / companies with state participation of some codes of OKPD2 or deliberate establishment of characteristics and requirements for the subject of procurement, ensuring the purchase of exclusively foreign products;

- non-application by customers of the national regime established in Article 14 of Federal Law No. 44-FZ in relation to the procurement of quota goods;

- falsification and delivery for public procurement / purchases under 223-FZ of knowingly foreign products under the guise of Russian products;

- issuance by authorized bodies of knowingly false confirmations of the Russian origin of foreign products;

- other violations in the sphere of fulfillment by customers of the minimum share of purchases of Russian goods established by Resolutions No. 2013, 2014.
